EQUAL PAY Scottish Borders Branch UNISON have had a huge amount of enquiries from Members on the subject of Equal Pay Compensation Payments being offered to groups of Staff by Scottish Borders Council. UNISON believe that there are more than “Manual Predominately Female Jobs Without Bonus” who have been discriminated against in the past. At this time however, only these particular groups of Staff have being offered any sort of Compensation. Until job evaluation is completed, the full extent of the pay discrimination that has been suffered by many Staff is impossible to quantify. SBC have intimated they intend to share the results of job profile evaluation, but some of the information is still with the Council. If you feel you may have an Equal Pay Case that you wish UNISON to look further into, then please contact your Branch to request that an Equal Pay Case Form be sent to you. To send you a Case Form we need your Name, Address, Workplace and Job Title along with your Membership Number. A number of UNISON Members are now in grievance procedures and are seeking an acceptable offer to compensate for their jobs being undervalued and not being paid Equal Value to their Comparators. If the Council are unable to make offers that are agreeable for these Members, then cases are expected to go forward to Employment Tribunals. Many of our local cases are already lodged with Employment Tribunal. If you have an
Equal Pay Case lodged with UNISON, please remember to inform your
UNISON Legal Contact of any changes to you Job and Terms and
Conditions. This includes any temporary changes such as secondments
etc. Also please notify us if you leave your job or change address.
This may be done either writing to your UNISON Contact or by
Emailing equalpayscotland@unison.co.uk . There are strict time limits for bringing equal pay claims in the Employment Tribunal. You cannot bring a claim unless you do so within six months of leaving your employer’s employment or six months of a change of contract. The six month time limit will start on the day Single Status comes into force.
